The U.S. Department of Commerce (DOC) issued final decisions in three scope proceedings, confirming that door thresholds are covered by the scope of the antidumping duty (AD) and countervailing duty (CVD) orders on aluminum extrusions from China. The proceedings followed requests for scope rulings from Columbia Aluminum Products, LLC, Worldwide Door Components, Inc., and MJB Wood Group, Inc. to determine whether imports of the door threshold products imported by these companies are subject to the AD/CVD orders.
“This is a clear win for the aluminum extrusion industry in the United States,” said Jeff Henderson, president of the Aluminum Extruders Council (AEC). “The trade orders, which have been in effect since April 2011, clearly state door thresholds were covered by our orders. It was very important to the AEC and its members that Commerce stand by its orders and declare these extrusions subject to the duties.”
The AEC and Endura Products Inc. jointly participated in these proceedings and provided the DOC with critical information demonstrating that door thresholds containing extruded aluminum are plainly covered by the scope of the AD/CVD orders and were intentionally included within the scope by the petitioner during the original investigations.
The DOC agreed and confirmed the express inclusion of the extrusion in the door thresholds to be within the scope of the AD/CVD orders and explained that for this reason, door thresholds cannot be removed from the coverage of the orders pursuant to a claim that these products are finished merchandise.
“We applaud the Commerce Department’s decision, which is an important step forward in addressing the evasive practices that we have seen from various Chinese extruders,” said Robert DeFrancesco, counsel to the AEC and Endura Products. “This ruling is critical for ensuring that the AD/CVD orders are effectively enforced so that American jobs are not harmed from unfair trade. We urge the Commerce Department and U.S. Customs and Border Protection to continue to take all necessary measures to ensure that the AD/CVD orders on aluminum extrusions are being fully enforced.”
